Functions


Plots included in the auction schedule are selected by the Committee, keeping in view the trends of market and importance of location of plots. However, public can also apply for inclusion of available plots of Scheme or blocks in the auction schedule.
All commercial/industrial plots, leases of petrol pump sites, parking areas and earmarked residential plots are put to open auction.
Auction Notice is published in national dailies, indicating the number of plots, blocks, Sectors with date, time and place, which generally is LDA Complex, 7-Court Street Lahore.
On the publicized date, auction is held under the supervision of Auction Committee.
The intended bidders, have to deposit Rs.25,000/- for a residential plot and Rs.50,000/- for commercial, with the Bank counter available at site to facilitate participation in the bids.
People can also authorize some other persons in writing, to participate in bid on their behalf.
One third amount of the total cost of bid is recovered from the successful/highest bidder at the fall of hammer.
Highest bids are subject to approval of the competent authority, for acceptance or rejection.
The unsuccessful bidders are informed to get refund whereas successful bidders are issued recovery memos with terms and conditions
Possession letter is issued after recovery of total bid money.
In case of default in payment of full bid money, balance amount is refunded after cancellation of bid and deduction of 10% of the total cost of plot.

 

Plots/Sites earmarked for Educational Institutions, Mosques,Health Centres/Hospitals, Government Banks etc come under ambit of Public Utility Sites.

Public Utility Sites are allotted to Government Departments and Private Organizations.

In case of Private Organization, Chairman LDA, is the final Authority to approve the allotment.

The reserve price of Utility Sites is fixed by LDA's Price Assessment Committee, at the rate of one third of prevailing market price of residential plots in the scheme or adjoining area.

In case of Educational Institutions, the applicant Institution should be recognized or sponsored by the relevant Government Department or Statutory Body established under law (such as Board of Intermediate or University etc.) and its requirement of land should be determined by the relevant Government Department (Secretary Education, Government of Punjab) or statutory Body established under law.

The plots reserved for Mosques are allotted on the recommendations of District Mosque Committee.

In case of plots reserved for Health Centres/Hospitals, the allotment is made on the recommendations of the Government of Punjab (Health department).

Sites reserved for Government Offices such as Post Office, Police Station are transferred to the Department concerned at reserve price.

Sites reserved for Graveyards are transferred to District Administration which is responsible to check encroachments or unauthorized use of site. The maintenance is carried out by the local councils.

Banks Sites are to be disposed of on lease basis through open auction where only schedule Banks will participate. However, reserve price will be fixed on the basis of current market price to avoid pooling. All such sites/plots will be allotted on lease basis.

The sites/plots reserved for petrol pumps will be leased out though open auction.

 


Disposal of land by Development Authorities Act-1998,is the governing law on the subject. It lies down that the plots will be disposed of according to the following criteria. Plots falling in zone of above 10-Marlas and constructed units shall be disposed of through open auction:-

Auction is periodically held after giving wide publicity.
After calculating the quota for Defense personnel, it is conveyed to the army authorities for its utilization. Allotment letter is issued to the person at reserved price, whose case is recommended by army authorities.
Applications are invited from the destitute for allotment against Destitute Quota. In case the number of applications exceeds the number of available plots, then ballot is drawn.

If encroachments on LDA property or on LDA vacant plots or right of public way takes place, it is detected and reported by field staff.
General public can also pin point any such encroachment by informing telephonically or moving an application on simple paper.
A well equipped team, comprising Estate Officer, LDA/Demolishing Squad, along with police and Magistrate is sent at site to take action, to remove the encroachments.
Once the possession of plot is delivered to the allottee/ purchaser, the responsibility of LDA to check encroachment on such plots ends.

Recoverable cost and prescribed period of payment are incorporated in the recovery memo which is comprehensive and need to be followed by the owner of plot. If payments are delayed, interest @17.5% per annum, is imposed .
On default of payments, LDA issues simple notice, which is followed by the final notice.
Payment can be made through cheque, bank draft or through challans which can be collected by hand and paid in the Bank, which is also mailed to applicant after waiting for 7-days.
In case of default, after issuance of notices, plots is liable to be cancelled. Therefore it is advisable that owner of plots may respond to the notices positively.
After cancellation, the allotment of plot can be restored on payment of all recoverable dues with interest @17.5% per annum and 10% restoration charges on the cost of plot.
LDA can also enforce recovery of stuck up arrears, through Tehsildar Recovery, as Land revenue, if so required.

After issuance of possession letter from concerned branch of LDA, in favour of allottee/exemptee or auction purchaser, the applicant has to apply at One Window Counter to Director Estate Management for handing over physical possession of the said plot.
On receipt of application, the applicant is informed in writing, indicating the date, time and venue in that scheme, for his being present to take over possession of plot from LDA field staff.
On fixed date, possession at site is handed over to applicant by LDA field staff.
Subsequently, letter bearing mention that physical possession to this effect has been given to applicant is issued on mailing address of the applicant on the same day.
After delivery of possession by LDA, the owner of plot becomes responsible to protect his plot from any adverse possession.

Policies



The Seller applies at One Window counter for obtaining Clearance Certificate, about the title and payment position of the plot.
After having obtained the Clearance Certificate, the intended purchaser/seller submits duly filled Transfer Application at one Window counter complete in all respect. Relevant instructions given on the rare side of Transfer form are required to be followed by the applicant.
Transfer Fee Challans at the rate specified for different categories are given to applicant on the given date.
After receipt of paid Challan supplied by applicant, and received through one window counter, transfer letter is issued to the transferee.

Transfer of Industrial plots is affected on the rates prescribed by the Government and on the N.O.C. issued by the Department of Industries & Mineral Development. In addition to the transfer fee charged by LDA, the following rates are specified by the Government:

The Building Period Extension Policy is framed by HUP & EP Department and is notified for implementation, from time to time.
In case of LDA, Policy bearing No.SO(D-II)2.3/92 dated 19.10.93 is applicable.
7.    After expiry of stipulated building period, which is three years, extension in building period is given on the request of owner of plot as per rules, at following rates, on submission of application.

8.    The owner of the plot has to apply to LDA through one window counter , indicating the name of financial institution or bank in whose favour N.O.C by LDA is required to be issued.
9.    Applicant is advised to enter into an Agreement for sale, which is signed, by the applicant and authorized officer of LDA, and it is got registered in Sub-registrar's office for its presentation to H.B.F.C. to full fill their requirement.
In cases where applicants intend to have loans from banks an undertaking is obtained that applicant will not do any transaction during the period when plots remain mortgaged with the banks.
N.O.C on printed form is issued on due date
12.N.O.C for loan is only issued for procuring house building loan. Once the house is constructed and completion certificate is issued by Town Planning Wing of LDA, then N.O.C is not issued.

Party/allottee has to apply to LDA in writing through One Window for issuance of N.O.C for presentation to the Sui gas authority.
Challan is issued for the due amount to applicant by LDA who has to deposit the same in the bank.
Copy of the paid challan is to be furnished to the office by applicant and thereafter, N.O.C is issued to the applicant.

Sale deed is the last and final document executed by LDA in favour of owner of plot, after which proprietary rights vest in owner.
There are three prerequisites of sale deed (i) entire dues are cleared/deposited (ii) building on plot should be completed and (iii) completion certificate is issued by Town Planning Wing LDA.
After getting the completion certificate issued the owner may apply for execution for sale deed through one window to Director Estate Management with three specimen signatures, one photograph, a copy of National Identity Card duly attested by Gazetted officer
Printed form for sale deed is given to the applicant for getting the adhesive stamps embossed on it from Government Treasury.
Sale deed has to be signed by the allottee, auction/purchaser and Director Estate Management.
Sale deed is registered with the Sub Registrar concerned. Representative of LDA and the owner has to be present in the office of the Sub Registrar at the time of registration.
After the sale deed is registered with Sub Registrar, original sale deed is given to the owner and copy is retained in the office of the DEM.
