  5. Three copies of Layout Plan on a Town Planning Scale duly signed by a Registered Town Planner.

  6. Three copies of survey plan on a Town Planning Scale.

  7. Scrutiny fee @Rs.1,000/- per Acre.

  8. NOC from WASA for Advance Cost of Trunk Infrastructure.

 

 

Consequent upon the approval accorded by the Ex-Chief Minister, Punjab, in September, 1999 the following instructions were circulated vide this Department's memo No.SO(DI)14-3/98(B) dated 20.09.1999:-

  1. All revised layout plans submitted by the sponsors of private housing schemes after approval of the schemes should be treated as cancelled. Only the original layout plans submitted at the time of approval of the schemes should be considered as correct and valid.

  2. If some necessary technical changes are required which are indispensable for the schemes, then revised layout plans should be resubmitted for scrutiny to the Chairman of the Authority through the Director General concerned and Secretary HUD&PHE Department for revised approval. No revised plan should be entertained by Town Planners directly unless and until it has been thoroughly examined by the Department and approved by the Chairman.

2. On receipt of numerous representations from the Developers, in order to resolve the issues involved, the Minister HUD&PHE held a meeting with the Association of Developers on 22.11.2000. The case was submitted to the Governor, Punjab who has been pleased to approve revision of the policy to the extent as detailed below:-

  1. Revised layout plans sanctioned in accordance with the law prior to the instructions dated 20.09.1999 shall not be cancelled.

  2. The schemes which do not involve change in land use but involve a modification on the account of addition of certain pockets in the originally approved schemes or minor adjustment are required, the amended schemes may be approved by the Director General of the Development Authority concerned. However, in case of revised housing schemes where changes in land use are required, which are indispensable for the schemes then the revised layout must be submitted by the Development Authorities to the HUD&PHE Department of approval.

3. The above instructions may be brought to the notice of all concerned for strict compliance in letter and spirit.

 

NOTIFICATION

In pursuance of Clause-5 of the Notification dated 28-04-2001, issued by Secretary HUD PHE Department and decision of the Lahore Development Authority dated 02-06-2001, the recovery of Proportionate Cost of Sewerage Trunk Infrastructure from the sponsors of private housing schemes or from the individual plot/house owners of private housing schemes, where the scheme had already been approved and completed shall be made as follows:

CATEGORY-II

Approved private housing schemes where trunk sewerage infrastructure not laid but planned

  1. 15% charge immediately

  2. 85% at the time, when more than 50% development works in the private housing schemes completed and trunk sewer laid by WASA (Above 85% will be recovered on the prevailing cost at the time of physical connection)

 

 

BASIS OF CHARGING PROPORTIONATE COST OF SEWERAGE INFRASTRUCTURE FROM PRIVATE HOUSING SCHEMES COVERED CATEGORY III

Rs.11000/- per kanal on the saleable area of the scheme as per approved plan of private housing schemes

In case, the sponsors or the management committee of the private housing scheme do not exist, recovery of the charges will be affected from the individual owners of the plots/houses.

CIRCULAR

No.SO(D) 1-44/98. In pursuance of the decision taken by the Provincial Cabinet in the meeting held on 10/4/2001, recovery of proportionate cost of "Sewerage Trunk infrastructure" from the sponsor(s) of private housing schemes shall be made as follows. This Circular shall supersede this department's Memo No.SO(P)-HUD&PHE/137/98 dated 18/5/1999 and LDA's No.MD/734 dated 19/8/1999:-

  1. Areas where the trunk sewer has already been laid, the proportionate cost shall be recovered as under:-

    1. 20% at the time of approval of the scheme

    2. 30% at the time of approval of the design of water supply and sewerage system

    3. 50% at the time when more than 50% development works have been completed
      by the developer(s)

  2. Area where the trunk sewer has not been laid but has been planned and a provision is expected in the near future, proportionate cost of trunk sewer may be recovered from the sponsor(s) /developer(s) of the private housing scheme(s) as follows:-

    1. 10% at the time of approval of the scheme

    2. 15% at the time of approval of the design of water supply and sewerage system

    3. 75% at the time when more than 50% development works have been carried out and the trunk sewer has been laid by the Development Authority concerned

  3. Areas where trunk sewer has neither been laid nor planned so far by the Development Authority concerned, the sponsor(s) of private housing schemes shall submit an undertaking to pay the proportionate cost of trunk sewer as and when the same is laid.

  4. The cases falling in No.(iii) above shall be upgraded to the cases falling in NO.(ii) and (i) above once the requisite planning/development has been undertaken by the concerned Development Authorities and others concerned. Similarly cases falling in No.(ii) shall be upgraded to cases falling in NO.(i) above after the requisites are done.

  5. The cases of all such schemes as had already been completed and connected to trunk sewerage infrastructure shall be submitted to the "Chairman" of the Authority for decision regarding the manner of recovery of the proportionate cost.

Rules & Regulations

 

SHORT TITLE AND COMMENCEMENT
These rules shall be called the Punjab Private Housing Schemes (Regulation) Rules, 2004.
  • They shall come into force at once.
  • These rules shall extend to the entire province except the areas falling in the limits of the Cantonment Boards.
DEFINITIONS

In these rules unless the subject or context otherwise requires:

  • COMPANY means a Company registered under the Companies Ordinance, 1984.
  • COOPERATIVE SOCIETY means a Society registered under the Cooperative Societies Act, 1925.
  • DEVELOPER means the owner(s) of land or a Cooperative Society or a Company who intends to develop a Scheme.
  • DEVELOPMENT AUTHORITY means the Lahore Development Authority, an Authority established under the Punjab Development of Cities Act, 1976 and the Punjab Housing and Town Planning Agency.
  • GOVERNMENT means the Government of Punjab.
  • ORDINANCE means the Punjab Local Government Ordinance, 2001.
  • SCHEME means a private housing scheme including farm housing.
  • SCRUTINY COMMITTEE means a Committee constituted to scrutinize the Housing Scheme outside the jurisdiction of Development Authority.
  • TMA means Tehsil Municipal Administration constituted under the Punjab Local Government Ordinance, 2001.
  • TOWN PLANNER means a qualified Town Planner registered with the Pakistan Council of Architects and Town Planners.(2) Words and expressions used herein but not defined shall have the same meanings as are assigned to them in the Ordinance.

 

Scrutiny of Schemes

A Developer shall submit an application for approval of a scheme to the TMA or to the Development Authority as the case may be along with the following:

 

1. Ownership documents including Khasra plan of the entire land proposed for the scheme duly verified by the Revenue Authorities of the area along with non-encumbrance certificate;
    a. Location plan of the scheme prepared by a Town Planner;
    b. Topographic plan / site survey of the area;

2. Layout plan prepared by a Town Planner
    a. Copy of the National Identity Card of the Applicant / Main Sponsor.

3. Fee for approval
    a. Fee for approval to be deposited as per demand of TMA / Development Authority as the case may be.

 

 

The TMA / Development Authority will examine the case keeping in view the following aspects:

All the documents as per 3(i) are complete.

That the proposed site fulfils the following requirements:

The access road shall not be less than 30'

The site shall not be liable to flooding.

The minimum area of the scheme shall not be less than 160 kanal.

The land is not required or have been notified by the Government for any other purpose.

4.1 In case any of the aforementioned parameters is not fulfilled, the scheme shall not be entertained. The Developer shall be informed accordingly by the
TMA / Development Authority as the case may be within fifteen days from the date of receipt of the application.

The TMA shall forward the complete case to the Scrutiny Committee.

The Development Authorities shall process the case within their office.

 

OWNERSHIP DOCUMENTS

The Scrutiny Committee or Development Authority as the case may be shall verify the ownership documents. After clearance of the land title a public notice inviting public objections shall be published in the press at the cost of the Developer with fifteen days' notice for filing objections. The objections, if received, shall be communicated to the Developer by the TMA or Development Authority as the case may be.

 

For the purpose of roads and residential use the “National Reference Manual On Planning and Infrastructure Standards” may be kept in view. The land uses other than the above shall be as under:

a. Open Spaces / Parks Not less than 7% of total scheme area
b. Graveyard Not less than 2% of total scheme area
c. Commercial Area Not more than 5% of total scheme area
d. Public Buildings 2% to 10% of total scheme area
e. Maximum size of Residential Plots 1000 Sq.Yds
f. Minimum Road width 30 Feet.

 

 

 The Scrutiny Committee shall examine the Scheme according to the planning standards and shall convey observations if any to the TMA within 07 days. The Developer shall resubmit the scheme after attending the observations within 10 days.

In case of Development Authority, such observations if any, shall be conveyed by the Authority to the Developer within 07 days. The Developer shall resubmit the scheme after attending the observations within 10 days.

PLANNING APPROVAL

(i) In case the Scrutiny Committee recommends the scheme for approval then the TO(P&C) shall issue the approval within 07 days.

(ii) In case of Development Authorities for the areas falling within their controlled area, the approval shall be issued by the Development Authority.

 

1. Sequent to the planning approval the Developer shall be required by the Development Authority or Tehsil Municipal Administration in other areas as the case may be, to:

 

  •          Submit Transfer Deed for transfer of the area under roads, open spaces, graveyard, public buildings to the Development Authority or Tehsil Municipal Administration as the case may be.
  •            Mortgage 30% of the saleable area with the Development Authority or Tehsil Municipal Administration as the case may be, as a security for the provision of infrastructure and services or a Bank Guarantee equal to the total cost of development of the scheme to the satisfaction of the Development Authority or Tehsil Municipal Administration as the case may be.
  •            Transfer the area under roads, graveyard, open spaces to the Development Authority or Tehsil Municipal Administration as the case may be.
  •          Transfer 1% of the total scheme area meant for public buildings (excluding the area of mosque) to the Development Authority or Tehsil Municipal Administration as the case may be. That area shall not be converted into any other use by the Development Authority or Tehsil Municipal Administration.
    2. A public notice shall be published in the press at the cost of the Developer giving the details of plots mortgaged with the Development Authority or Tehsil Municipal Administration as the case may be, to the effect that such plots shall not be purchased until the same are released after satisfactory completion of development works.
    3. After completion of the above formalities a formal letter of approval shall be issued by the TO(P&C) or the Development Authority within 07 days and the Developer shall be allowed to advertise the Scheme.
    4. The approval letter shall require the Developer to include the following in the advertisement:
  • Total area of the Scheme along with its location.
  • Total number of residential plots of various sizes.
  • The details of plots mortgaged with the Development Authority or the Tehsil Municipal Administration as the case may be .
  • Price of plot and schedule of payment.
  • Period for completion of development works.
  • The letter of approval.
  • In case of allocation of plots through ballot, it shall be indicated in the advertisement.

 

i. The Developer shall submit the following after approval of the Scheme to the Development Authority or Tehsil Municipal Administration as the case may be, within 3-months of the approval:

Detailed design & Specifications of water supply system.

Detailed design & Specifications of sewerage system.

Detailed Design & Specifications of drainage system.

Detailed Design & Specifications of roads and streets.

Detailed design and specifications of electric network.

The development works shall be commenced after approval of the above designs by the Development Authority or Tehsil Municipal Administration or WAPDA as the case may be within 30 days.

ii. The development and maintenance of the scheme shall be the responsibility of the Developer.

 

Following shall be applicable on Farm Housing:

Plot size shall not be less than 4 kanal.

Road width shall not be less than 60 feet.

5% area of the Scheme shall be reserved for public utility plots wise; schools, dispensaries, open spaces and play grounds, mosques, post office, police station, bus terminal, public toilets, community centre etc. An area for the graveyard shall be provided @ 2% of total area of the Scheme.

The sub-division of plots shall not be allowed.

10% of saleable area shall be mortgaged with the Development Authority or Tehsil Municipal Administration as the case may be, as a security for development or bank guarantee equivalent to the cost of development shall be provided by the Developer to the Development Authority or Tehsil Municipal Administration in other areas, as the case may be.

 

The mortgaged plots shall be released proportionate to the development works by the Development Authority or Tehsil Municipal Administration as the case may be, on a field report about the satisfactory completion of infrastructure works including roads, water supply system, sewerage system, electricity by the respective agencies.

AMENDMENT

No amendment in the approved scheme shall be made without observing the procedure under the rules, for the approval of the scheme.

PENALTY FOR CONVERSION / AMENDMENT / VIOLATION

If any change is effected in the approved scheme, except in the prescribed manner, it shall be an offence punishable under the enabling provisions of the relevant applicable Ordinance / Acts.

SUPERVISION AND CONTROL

Government may call for and examine the record of any proceedings for the purpose of satisfying to the correctness, legality or propriety of approval of Scheme, recommendations, observations, penalty or order recorded or passed and as to the regularity of any proceedings.

In case of City District Government the approval will be issued by the Lahore Development Authority in the Lahore District after declaring it as controlled area.

In case of other Development Authorities the approval will be issued by a Committee consisting of the DG of the Authority and the TO(P&C) of the TMA concerned

CONVEYANCE OF APPROVAL

Sequent to the planning approval the Developer shall be required by the Development Authority or Tehsil Municipal Administration in other areas as the case may be, to:

(i) Submit Transfer Deed for transfer of the area under roads, open spaces, graveyard, public buildings to the Development Authority or Tehsil Municipal Administration as the case may be.

(ii) Mortgage 30% of the saleable area with the Development Authority or Tehsil Municipal Administration as the case may be, as a security for the provision of infrastructure and services or a Bank Guarantee equal to the total cost of development of the scheme to the satisfaction of the Development Authority or Tehsil Municipal Administration as the case may be.

          (iii) Transfer the area under roads, graveyard and open spaces to the Development Authority or Tehsil Municipal Administration as the case may be.
