Functions

 

  1. Sale of vacant residential and commercial plots and constructed units in LDA Schemes, through open auction.

  2. Allotment of plots earmarked for utility sites in LDA Schemes, to applicant organization and Government Departments, on reserve price.

  3. Allotment of plots to specified groups, laid down in Disposal of Land by Development Authorities (Regulation) Act.1998.

  4. Protection of LDAs immovable properties and removal of encroachments on vacant plots/LDA's unsold constructed units/roads in the schemes of LDA.

  5. Recovery of cost/price of sold and allotted plots.

  6. Delivery of possession of allotted/auctioned/exempted plots, to their rightful owners.

  7. To allow transfer of plots.

  8. To allow extension in building period of plots.

  9. To issue No Objection Certificate (N.O.C) for obtaining loan for house building from House Building Finance Corporation and Banks.

  10. To issue N.O.C for obtaining Sui Gas  connection.

  11. To execute sale deeds of plots. After execution of sale deed rights are transferred to and vest in allottee proprietary.

 

 

  1. Plots/Sites earmarked for Educational Institutions, Mosques, Health Centres/Hospitals, and Government Banks etc come under the ambit of Public Utility Sites.

  2. Public Utility Sites are allotted to Government Departments and Private Organizations.

  3. In case of Private Organization, Chairman LDA, is the final Authority to approve the allotment.

  4. The reserve price of Utility Sites is fixed by LDA's Price Assessment Committee, at the rate of one third of prevailing market price of residential plots in the scheme or adjoining area.

  5. In case of Educational Institutions, the applicant Institution should be recognized or sponsored by the relevant Government Department or Statutory Body established under law (such as Board of Intermediate or University etc.) and its requirement of land should be determined by the relevant Government Department (Secretary Education, Government of Punjab) or statutory Body established under law.

  6. The plots reserved for Mosques are allotted on the recommendations of District Mosque Committee.

  7. In case of plots reserved for Health Centres/Hospitals, the allotment is made on the recommendations of the Government of Punjab (Health department).

  8. Sites reserved for Government Offices such as post Office, Police Station are transferred to the Department concerned at reserve price.

  9. Sites reserved for Graveyards are transferred to District Administration which is responsible to check encroachments or unauthorized use of site. The maintenance is carried out by the local councils.

  10. Banks Sites are to be disposed of on lease basis through open auction where only schedule Banks will participate. However, reserve price will be fixed on the basis of current market price to avoid pooling. All such sites/plots will be allotted on lease basis.

  11. The sites/plots reserved for petrol pumps will be leased out though open auction.

 

 

Disposal of land by Development Authorities Act-1998, is the governing law on the subject. It lays down that the plots will be disposed of according to the following criteria. Plots falling in zone of above 10-marlas and constructed units shall be disposed of through open auction:-

2. By way of allotment, on the reserve price, to the Defence personnel who become permanently disabled or the legal heirs of the Defence personnel who lay down their lives in the discharge of official duties. 3.5 % 3.5 %
3. By way of allotment on the reserve price, to such persons who become permanently disabled in the performance of functions or voluntary services in relation to the affairs of the Government or the legal heirs of the persons who die while performing such functions or services. 1.5 % 1.5 %
4. By way of allotment on the reserve to the destitute (i.e disabled persons who are permanently incapacitated other than those in public duty to earn their livelihood or a widow or minor, orphan whose monthly income does not exceed Rs.2000 per month). - 5.00 %

 

  1. Auction is periodically held after giving wide publicity.

  2. After calculating the quota for Defence personnel, it is conveyed to the army authorities for its utilization. Allotment letter is issued to the person at reserved price, whose case is recommended by army authorities.

  3. Applications are invited from the destitute for allotment against Destitute Quota. In case the number of applications exceeds the number of available plots, then ballot is drawn. 

 

 

  1. If encroachments on LDA property or on LDA vacant plots or right of public way takes place, it is detected and reported by field staff.

  2. General public can also pin point any such encroachment by informing telephonically or moving an application on simple paper.

  3. A well equipped team, comprising Estate Officer, LDA/Demolishing Squad, along with police and Magistrate is sent at site to take action, to remove the encroachments.

  4. Once the possession of plot is delivered to the allottee/ purchaser, the responsibility of LDA to check encroachment on such plots ends.

 

 

  1. Recoverable cost and prescribed period of payment are incorporated in the Computerised recovery memo which is comprehensive and need to be followed by the owner of plot. If payments are delayed, in allotment case interest @17.5% per annum, is imposed. Extension in payment period in Auction cases is not allowed.

  2. On default of payments, LDA issues simple notice, which is followed by the final notice.

  3. Payment can be made through cheque, bank draft or through computerised challans which can be collected by hand and paid in the Bank, housed in the LDA Complex which is also mailed to applicant after waiting for 7-days. Payment within time in Auction has to be ensured by Auction purchasers.

  4. In case of default, after issuance of notices, plots are liable to be cancelled. Therefore it is advisable that owner of plots may respond to the notices positively.

  5. After cancellation of the allotment of plot, it can be restored on payment of all recoverable dues with interest @17.5% per annum and 10% restoration charges on the cost of plot.

  6. LDA can also enforce recovery of stuck up arrears, through Tehsildar Recovery, as Land revenue, if so required.

 

 

  1. After issuance of possession letter from concerned branch of LDA, in favour of allottee/exemptee or auction purchaser, the applicant has to apply at One Window. LDA Complex to Director Estate Management for handing over physical possession of the said plot.

  2. On receipt of application, the applicant is informed in writing, indicating the date, time and venue in that scheme, for his being present to take over possession of plot from LDA field staff.

  3. On fixed date, possession at site is handed over to applicant by LDA field staff.

  4. Subsequently, letter bearing mention that physical possession to this effect has been given to applicant is issued on mailing address of the applicant on the same day.

  5. After delivery of possession by LDA, the owner of plot becomes responsible to protect his plot from any adverse possession.

 

 

OBTAINING N.O.C. FOR SALE OF PLOTS:-

When the Allottee/Transferee or GPA holder intends to sell the property, He or She applies through One Window Cell for issuance of a No Objection Certificate regarding the property in question. On receipt of such a request, the relevant property file is examined by the Allotment and Recovery Sections and in case of clearance of all dues, the requisite N.O.C. is issued through One Window within seven days.

DOCUMENTS REQUIRED:-

  1. Duly attested printed transfer Application Form available from Window No.3. (Embedded-1)

  2. Affidavit from seller and purchaser on Stamped Paper worth Rs.20/- attested by Magistrate/Ist Class Officer. (Embeded-2)

  3. Photocopy of Identity Cards attested both the parties.

  4. Photograph attested both the parties.

  5. Three specimen signature attested both the parties.

  6. Statement regarding handing over/taking over of possession of plot. (Embedded-3)

 

 

  1. The Seller applies at One Window counter for obtaining Clearance Certificate, about the title and payment position of the plot.

  2. After having obtained the Clearance Certificate, the intended purchaser/seller submits duly filled Transfer Application at Window No. 3 complete in all respect. Relevant instructions given on the rare side of Transfer form are required to be followed by the applicant.

  3. Transfer Fee Challans at the rate specified for different categories are given to applicant on the given date.

  4. After receipt of paid Challan supplied by applicant, and received through one window counter, transfer letter is issued to the transferee.

 

 

 

  1. The Building Period Extension Policy is framed by HP&EP Department and is notified for implementation, from time to time.

  2. In case of LDA, Policy bearing No.SO(D-II)HP&EP-2-3/92 dated 19.10.93 is applicable.

  3. After expiry of stipulated building period, which is three years, extension in building period is given on the request of owner of plot as per rules, at following rates, on submission of application.

 

Policies/Laws

 

  1. The owner of the plot has to apply to LDA through one window counter (LDA Complex, 9-court street), indicating the name of Financial institution or bank in whose favour N.O.C.by LDA is required to be issued.

  2. Applicant is advised to enter into an Agreement for sale, which is signed, by the applicant and authorised officer of LDA, and it is got registered in Sub-registrar's office for its presentation to H.B.F.C. to full fill their requirement.

  3. In cases where applicants intend to have loans from banks an undertaking is obtained that applicant will not do any transaction during the period when plots remain mortgaged with the banks.

  4. N.O.C. on printed form is issued on due date.

  5. N.O.C. for loan is only issued for procuring house building loan. Once the house is constructed and completion certificate is issued by Town Planning Wing of LDA, then N.O.C. is not issued.

 

 

  1. Party/allottee has to apply to LDA in writing through One Window for issuance of N.O.C.for presentation to the sui gas authority.
  2. Challan is issued for the due amount to applicant by LDA who has to deposit the same in the bank branches housed in LDA Complex.
  3. Copy of the paid challan is to be furnished to the office by applicant and thereafter, N.O.C. is issued to the applicant.
  4. The scheme wise Sui Gas Charges are as under :-

i)- M.A. Johar Town Rs.800/- per marla
ii)- Sabzazar Rs.735/- per marla
iii)- Tajpura Rs.735/- per marla
iv)- Gujjarpura Rs.800/- per marla
v)- Mohlanwal Rs.735/- per marla
 

 

 

  1. Sale deed is the last and final document executed by LDA in favour of owner of plot, after which proprietary rights vest in owner.

  2. There are three prerequisites of sale deed (i) entire dues are cleared/deposited (ii) building on plot should be completed and (iii) completion certificate is issued by Town Planning Wing LDA.

  3. After getting the completion certificate issued the owner may apply for execution for sale deed through one window to Director Estate Management with three specimen signatures, one photograph, a copy of National Identity Card duly attested by Gazetted officer.

  4. Printed form for sale deed is given to the applicant for getting the adhesive stamps embossed on it from Government Treasury.

  5. Sale deed has to be signed by the allottee, auction/purchaser and Director Estate Management.

  6. Sale deed is registered with the Sub Registrar concerned. Representative of LDA and the owner has to be present in the office of the Sub Registrar at the time of registration.

  7. After the sale deed is registered with Sub Registrar, original sale deed is given to the owner and copy is retained in the office of the DEM.
